Juridical Analysis of the Misuse of Personal Data for Regional Head Candidacy as a Criminal Offense

Abstract

One of the crucial aspects of the political process is the nomination of regional leaders, where candidates often require personal data for various administrative and campaign purposes. In the context of Regional Head Elections (Pilkada) in Indonesia—particularly the highly scrutinized DKI Jakarta Pilkada—the misuse of Identity Cards (KTP) has become a serious issue. A recent case involving the unauthorized use of KTPs by gubernatorial candidates Dharma Pongrekun and Kun Wardana has drawn public attention regarding personal data protection. This study employs normative juridical legal research with a statute and conceptual approach. The author examines Indonesian regulations on personal data protection from a criminal law perspective, as such actions violate current laws.
