Fulfillment of the Right to Education by Local Governments in the Era of Regional Autonomy

Abstract

This study aims to examine how local governments fulfil people's right to education during decentralization as an implementation of the constitutional mandate that all Indonesians have the right to education and the state is obliged to provide it. Based on the findings of the study, the process of delegating authority from the national to the local level has been implemented by the East Java Provincial Government through the establishment of regulations and programs, such as free education for SMA/SMK students. This decentralization has had a positive impact on the fulfilment of the right to education that is more equitable and inclusive in the regions, especially in East Java, in accordance with the principles of justice and nondiscrimination in the 1945 Constitution of the Republic of Indonesia.
